Welcome to SelfDecode. Our goal at SelfDecode is to create an environment where you can learn about your genetic makeup, easily discover information relevant to your genetics and lifestyle, and connect with other people on the same journey. We aim to create tools that you can use to identify genetic variations of interest to you. We also aim to provide information that you can consider when thinking about how to respond to those variants of interest. For us to provide you with the Services described above we need to analyze files that contain data about your genetic variations. The information hidden in your genetic makeup is both extremely useful and personal.
“SelfDecode” means Decodify Me LLC, and/or its affiliates (“SelfDecode”, “SelfDecode Report Shop” “we”, “us”, “Lab Test Analyzer”). We provide website content, functionality, and other products and services to you when you visit or make purchases at http://www.selfdecode.com (the “Site”) or remotely through any SelfDecode applications (collectively, the “Services”). “Service” or “Services” includes SelfDecode’s products, software, services, consultations, the mobile app and website (including but not limited to text, graphics, images, and other material and information) as accessed from time to time by the user, regardless of if the use is in connection with an account or not.
SelfDecode provides the Services subject to the following terms and conditions.

1. Requirements for Use of the Services
By accessing or using the Site or Services, you agree to be bound by these Terms of Service. Please read them carefully.
Eligibility Requirements:
To use the Services, you represent and warrant that you:
Are at least 18 years old (or the age of majority in your jurisdiction).
Have the legal capacity to enter into a binding contract. 1
Are not prohibited by any applicable laws in your jurisdiction from using the Services.
If you do not meet these requirements, you may not access or use the Services.

In addition to these Terms of Service, your use of the Services is also governed by the following policies, which are incorporated herein by reference:
Privacy Policy: This policy details how we collect, use, and share your personal information, including your Genetic Information.
Platform Consent: This document outlines the risks and benefits associated with genetic interpretation and testing.
We may update these policies and the Terms of Service from time to time. The most current versions will always be available on our Site. We will not be liable if for any reason the Services or any portion are unavailable at any time or for any period.
Your continued use of the Services after the posting of any revised Terms of Service or policies constitutes your acceptance of the changes. For material changes to the Terms of Service, we will make reasonable efforts to notify you through prominent notices on the Site or via email.
3. Description of Services
SelfDecode provides the following services related to genetic interpretation:
a. Genotype File Upload and Genetic Information
You can upload your Genotype File (raw genetic data) obtained from a third-party DNA testing service.
By uploading your Genotype File, you grant SelfDecode permission to store, process, and analyze it to generate your Genetic Information.
“Genetic Information” refers to both the raw data in your Genotype File and any interpretations derived from it.
You retain ownership of your Genetic Information.
SelfDecode will handle your Genetic Information in accordance with our Privacy Policy, Platform Consent, and all applicable data privacy regulations.
b. SelfDecode Platform and Products
The SelfDecode Platform provides a personalized experience where you can access insights and purchase products based on your Genetic Information.
“SelfDecode Insights” are personalized reports and recommendations generated based on your Genetic Information.
“SelfDecode Products” are tools and services offered by SelfDecode that utilize your Genetic Information to provide specific benefits (e.g., health reports, wellness plans, etc.).
The SelfDecode Platform uses your Genetic Information to tailor results and product offerings to your individual needs.
c. SelfDecode Account
You can create a SelfDecode Account to manage your Genotype File, access SelfDecode Insights, purchase and track SelfDecode Products, and adjust your account settings.
Individual users are limited to a single Genotype File upload, while Professional users have unlimited uploads.
Professional users are subject to additional terms outlined in the “Professional Users Privacy Term Sheet.”
d. Additional Services
SelfDecode Services also include:
Utilities and tools for interpreting your Genetic Information.
A community platform for forum-based discussions.
These services may be modified or discontinued at SelfDecode’s discretion.
e. Subscription Membership
Access to the Services is provided through a subscription membership with various options (yearly, monthly, one-time fee).
Subscriptions cannot be paused.
Free trials and demo versions are available for you to explore the platform before purchasing a subscription or uploading your Genotype File.
SelfDecode reserves the right to terminate your membership for any reason, subject to the terms of our Privacy Policy.
You acknowledge that we may introduce new or enhanced technologies and features for collecting or interpreting genetic information in the future. Your initial purchase of the service does not grant access to these new or enhanced technologies or features without an additional fee. You will need to pay separate fees to have your genetic information collected, processed, or interpreted using any future technologies or features.
f. DNA Extraction and Analysis
If you purchase a DNA testing kit from SelfDecode, we will perform DNA extraction, sequencing, and data analysis to provide non-diagnostic reports and recommendations.
SelfDecode may use third-party laboratories for these processes, even if the sample collection kit is SelfDecode-branded.
By returning a sample kit, you consent to SelfDecode sharing your sample with these third-party laboratories.
SelfDecode will notify you if your sample cannot be processed due to insufficient DNA or contamination and will request a new sample.
4. Registering for and Accessing the Services
a. Account Creation:
Eligibility to Use the Services. Unregistered guests, free registered guests, paid subscribers, and people who purchase and/or activate a DNA kit are all “Users” under these Terms. Users are subject to SelfDecode’s Terms of Use, Privacy Policy, and Platform Consent requirements. Users must create an account to use the Services.
When creating an account, you must provide accurate and complete information, including:
Your name and email address.
Your date of birth.
Your sex at birth.
Your ethnicity.
Your genotype file (if you choose to upload it).
Payment information (if you purchase a SelfDecode Product).
By providing this information, you consent to SelfDecode using it in accordance with these Terms of Service, our Privacy Policy, Platform Consent, and any and all laws and regulations applicable to you. You consent to us using your information in ways that are consistent with our policies.
Alias Option:
You have the option to use an alias instead of your real name for your account login or for displaying your Genetic Information. If you choose to use an alias, it will be displayed in place of your real name on the SelfDecode Platform.
b. Account Security:
You are responsible for maintaining the confidentiality of your account password and for all activities that occur 1 under your account. You agree to notify SelfDecode immediately of any unauthorized account access or any other breach of security. You also agree to ensure that you exit from your account at the end of each session.
When accessing your account from a public or shared computer, you agree to use particular caution so that others are not able to view or record your password or your other information. SelfDecode is not liable for any loss or damage that results from your failure to comply with these obligations.
You authorize SelfDecode to authenticate your identity when accessing the Services. This may include asking you for your date of birth and other information that will allow SelfDecode to reasonably verify your identity.
c. Internet Access:
You are responsible for obtaining internet access to use the Services, including any associated fees and equipment.
d. Payment Information:
If you purchase a SelfDecode Product, you must provide valid payment information. You represent and warrant that you are authorized to use such a credit card or payment system account, and you agree to pay all charges incurred using your account.
You authorize SelfDecode to charge your chosen payment method for the products or services you order. All charges are exclusive of taxes, and you are responsible for paying any applicable taxes.
You agree that we may pass your credit card information and related personally identifiable information to our designated service provider(s) for their use in charging you for the services ordered by you.
We reserve the right to accept or reject orders for any reason. Price and availability of any service are subject to change without notice.
e. Conversion Tracking:
When you make a purchase on our Site, we may share information about your purchase with third-party conversion tracking providers. This information may include your IP address, purchase amount, and the time of purchase. This information is used to help us track the effectiveness of our advertising campaigns. You can learn more about our conversion tracking practices and your choices in our Privacy Policy.
f. Account Termination:
SelfDecode reserves the right to terminate your account at any time if we believe you have violated these Terms of Service.
5. Uploading Your Genotype File
a. Requirements for Uploading:
To upload your genotype file to the SelfDecode Platform, you must meet the following requirements:
Ownership or Consent: You must own the genotype file or have obtained prior written consent from the individual whose data it contains for all the uses SelfDecode may make of the data as described in these Terms of Service and our Privacy Policy.
Legal Authorization: You must be legally authorized to upload the genotype file and provide consent for its use on behalf of yourself or the individual whose data it contains.
Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) or be uploading a file for someone who meets this age requirement and can provide valid consent.
b. By uploading your genotype file, you agree to the following:
Data Analysis: You permit SelfDecode to analyze the genotype file to generate your Genetic Information.
Data Handling: You consent to SelfDecode collecting, processing, and storing your Genetic Information in accordance with these Terms of Service, our Privacy Policy, and Platform Consent.
Health Interpretations: You understand that any health-related interpretations provided by SelfDecode are for informational purposes only and are not intended to diagnose or treat diseases. You should consult with a qualified healthcare professional before making any decisions or taking any actions based on these 1 interpretations.
6. Purchases Using the SelfDecode Platform
a. Product Purchases:
The SelfDecode Platform allows you to purchase various products and services to gain deeper insights into your genetic information.
Payment: You agree to pay for all SelfDecode Products you purchase, including any applicable taxes and fees. Prices are subject to change at any time. We accept major credit cards and other secure payment methods.
No Price Protection: SelfDecode does not offer price protection or refunds for previous purchases if a product’s price is reduced or a promotion is offered later.
Insurance: SelfDecode does not submit or process insurance claims for its products or services. We do not expect them to be covered by health insurance and cannot guarantee reimbursement.
Data Usage: When you purchase a SelfDecode Product, SelfDecode will use the Genetic Information necessary to provide that product, as described in our Privacy Policy. We strive to use the minimal amount of data required for each product.
Product Recommendations: Based on your purchases and Genetic Information, SelfDecode may recommend other relevant products or services. You are under no obligation to purchase these additional offerings.
Product Updates: SelfDecode may update or modify its products from time to time. These updates may include changes to features, functionality, or data usage. We will make a reasonable effort to notify you of any material changes to the products you have purchased.
b. Subscriptions:
By registering for an account with SelfDecode, you will receive rights and privileges that are personal and non-transferable.
All sales and payments of fees (if any) are in US Dollars. SelfDecode is not responsible for any currency conversion or transaction fees charged by your payment method service provider.
We charge fees based on our sales agreement with you, whether that agreement is separately signed, or part of an online check-out process. We reserve the right to change prices for the Services at any time, but any such change will only apply to you when your then-current enrollment term is renewed.
You are responsible for paying any and all applicable sales and use taxes for the purchase of the Services. We may suspend or terminate your account and/or access to our Services if your payment is late and/or your offered payment method (e.g., credit card or PayPal account) cannot be processed.
Automatic Renewal: To ensure uninterrupted service, subscriptions automatically renew based on your chosen plan (e.g., monthly, annually) unless you cancel at least 30 days before the end of the current subscription period. You authorize SelfDecode to charge your chosen payment method for the renewal amount, including any applicable taxes. You acknowledge that auto-renewals are non-refundable.
If you discontinue an old Subscription plan no longer offered by stopping its renewal, or allowing it to expire, you are not guaranteed to be able to purchase it again at the same price in the future.
Prices and terms for subscriptions may change at any time. The price and terms in place when you made your initial purchase or when your subscription last renewed will stay in effect for the duration of that subscription period, but new prices and terms may apply to renewals or new subscriptions. SelfDecode will give you reasonable notice of any change in price or terms before they go into effect. If you do not want to renew your subscription under these new prices or terms, you may cancel your subscription as described below.
You hereby agree to allow SelfDecode to securely store your credit / debit card information (the “Payment Method”). You authorize the Payment Method to be used automatically for your payment responsibilities to SelfDecode. You agree and authorize the Payment Method to be billed automatically in accordance with the Membership Fee Payment Schedule in an amount equal to the Membership Fee in effect for your Membership Term.
If a credit card account is being used for a transaction, SelfDecode may obtain pre approval for an amount up to the amount of the payment. If you want to designate a different payment method or if there is a change in your Payment Method information, you can change the information with SelfDecode.
Cancellation: You can cancel your subscription at any time through your SelfDecode Account settings. Go to “My Account” > “Manage Subscriptions” > “Cancel My Subscription.”
Refunds: SelfDecode offers a 30-day money-back guarantee for subscriptions. If you are unsatisfied, you may request a full refund within 30 days of your initial purchase by contacting Customer Support (support@selfdecode.com). After 30 days, subscriptions are non-refundable.
You may discontinue use of the Services at any time. You also have the right to close your SelfDecode Account at any time through your SelfDecode Account settings. Genetic Information that has already been transferred to DNA Product Partners or Research Partners may not be able to be removed or de-identified from Partners’ databases by SelfDecode. You may also request that SelfDecode delete your data, in accordance with the process described in our Privacy Policy.
c. Refunds:
DNA Kits: DNA Kit purchases are non-refundable. Should you require a replacement DNA testing kit, you may email Customer Support (support@selfdecode.com) and provide the same information that you provided when you ordered your DNA Kit. Replacement kits are $25 per kit (plus applicable shipping and handling).
DNA Kit + Plans: All DNA Kit + Plans are non-refundable. This includes but is not limited to following plans: Health Insights, Premium Insights, Health & Ancestry Insights.
Individual Reports: All individually purchased reports, including but not limited to Ancestry, Medical Reports, Longevity Screener, Medication Check (Pharmacogenomics) , Family Planning (Carrier Status), Health Overview and Methylation Pathway are non-refundable.
Consultations: A refund may be requested for consultation purchases within 30 days of purchase if the consultation has not yet been completed. Consultations are non-refundable once completed. Monthly Consultation Subscription renewals are non-refundable.
Lab Shop: For Lab Shop orders, cancellations and refunds are subject to the following:
Full refund if canceled within 7 days of the order date and within the same calendar month.
Partial refund (minus a $15 fee) if canceled after 7 days but within the same calendar month.
Possible credit (at SelfDecode’s discretion, minus a $15 fee) if canceled in a subsequent calendar month.
d. Gift and Offer Codes:
SelfDecode may offer gift codes, offer codes, or other promotional codes.
These codes are redeemable for purchases on www.selfdecode.com, subject to certain restrictions.
Only valid codes provided by SelfDecode will be honored.
Codes cannot be combined, redeemed for cash, or refunded for returned items.
Expiration dates may apply.
Offer codes are void if copied, transferred, sold, exchanged, or expired, and where prohibited.
e. Spokespersons:
SelfDecode may engage spokespeople, influencers, or others who may be compensated for promoting the brand.
f. Lab Test Analyzer and Lab Sales:
All information on the Site is for informational purposes only and does not replace a physician’s consultation.
Lab test services are for wellness monitoring only and are NOT intended to diagnose, treat, or cure diseases.
Consult a healthcare professional for any health concerns or before making any decisions based on lab test results.
Individuals with medical conditions or any condition needing medical supervision assume full responsibility for obtaining professional medical assistance. You should consult a licensed and experienced health-care practitioner regarding any symptoms, abnormal health screens or medical conditions.
A lab test only constitutes a partial evaluation of an individual’s state of health and does not represent a diagnosis or recommendation. Each test has benefits, risks, limitations, false positives and negatives and accuracy is not guaranteed. Tests and test results are best interpreted in the context of your overall clinical evaluation with a physician.
SelfDecode works with Lab Testing API, Everly Health (PWN Health LLC), and Quest Diagnostics to provide our lab testing service. If your results are overdue please contact our customer service and we will work with Lab Testing API to resolve any issues that you may have. If you need to speak to a physician from Everly Health (PWN Health LLC) and are concerned about the content of your results please call 888-362-4321.
g. Re-shipping Home Test Kits:
A $20 reshipping fee applies for replacement kits due to loss, insufficient sample, or other reasons not attributable to SelfDecode.
By purchasing a home testing kit from our Lab Shop, you agree to pay the reshipping fee if a replacement kit is required for any reason. Please note that this fee is non-refundable and must be paid before the replacement kit is shipped.
SelfDecode shall not be liable to you or anyone else for any loss or injury caused in whole or in part by procuring, compiling, interpreting, delivering, or reporting information through this site or lab tests.
h. Consent for Use and Disclosure of Health Information:
I hereby authorize (i) SelfDecode (ii)Lab Testing API LTD (with its affiliates and staff, “Lab Testing API”) and (iii) PWN Remote Care Services, (with its affiliates and administrative services provider, “PWN”), including its physicians, their staff, agents and designees, including Everly Health (PWN Health LLC), as agent and administrative services provider and the laboratories that perform services requested by or consented by me (“PWN Parties”) to use and disclose health information about me in the manner and for the following purposes:
Providing Services: To facilitate and execute the services you request, including processing lab requests, delivering results, and providing consultations.
Treatment, Healthcare Operations, and Payment: To support your treatment, healthcare operations, and payment for services.
Health-Related Information: To provide you with information and materials on treatment alternatives, health offerings, and products that may be of interest to you.
Research: To conduct statistical research studies, as permitted by law.
This authorization applies to the use and disclosure of the following information about you: all information in requests(s) submitted by you or about you with your consent and the laboratory test values/results/information which are the result of the request(s) so submitted.
For the avoidance of doubt, you specifically authorize the transfer and release of this information to, between, and among yourself and the following individuals, organizations, and their representatives:
1. SelfDecode and its affiliates, their staff, and agents;
2. Lab Testing API and its affiliates, their staff, and agents;
3. PWN and its affiliates, physicians and their staff and agents (including Everly Health (PWN Health LLC));
4. The designated Everly Health (PWN) physician of record and its staff, agents, and designees;
5. The applicable laboratory of record and its staff and agents; and
6. Certain providers for the purposes herein, and as required or permitted by law.
You have the right to:
Access and Inspect: Request access to and inspect your health information.
Revoke Authorization: Revoke this authorization in writing at any time, except for information already disclosed.
Opt-Out: Opt out of having your information used for certain purposes, but this may affect the services provided to you.
i. Data Retention and Deletion:
SelfDecode will retain your data for as long as necessary to provide the Services and comply with legal obligations.
You may request that SelfDecode delete your data in accordance with our Privacy Policy. However, please note that some data may not be removable from partner databases due to technical limitations or legal requirements.
7. User Information and Content
a. User Content:
SelfDecode does not claim ownership of any content you create or submit while using our Services, including photos, forum comments, or profile updates (“User Content”).
By submitting User Content, you grant SelfDecode a non-exclusive, royalty-free license to use, modify, adapt, translate, publish, publicly perform, publicly display, distribute, reproduce, edit, reformat, and create derivative works of your User Content as necessary for the operation and improvement of our Services.
b. Feedback:
Any feedback, comments, or suggestions you provide (“Feedback”) will be treated as non-confidential and non-proprietary. SelfDecode may freely use and distribute Feedback without obligation or compensation to you.
c. Data Sharing and Consent:
Individual-level Data: SelfDecode will not share your individual-level Genetic Information or Self-Reported Information with third parties without your express consent, as described in our Privacy Policy.
Anonymized and Aggregated Data: We may share anonymized and aggregated Genetic Information and Self-Reported Information with third-party service providers, analytics platforms, translations services, research institutions, and commercial partners to enhance our services, conduct research, and improve health-related solutions.
Public Sharing: You are solely responsible for any Genetic Information or Self-Reported Information you share publicly or privately to any 3rd parties on the SelfDecode Platform. SelfDecode cannot control further distribution of information in such cases.
d. SelfDecode Research:
Consent for Research: If you consent to participate in SelfDecode Research, as described in the Informed Consent form and our Privacy Policy, you permit SelfDecode to use your anonymized Genetic Information and Self-Reported Information for research purposes. This may include sharing your anonymized data with third-party research partners and publication in scientific journals.
No Commercial Rights: You understand that by participating in SelfDecode Research, you acquire no rights to any commercial products developed as a result of the research.
e. Monitoring: SelfDecode reserves the right to monitor the use of its systems by its personnel and maintain records of such monitoring.
8. Links to Third-Party Sites
SelfDecode may provide links to third-party websites or services for your convenience. However, we do not endorse, control, or have any responsibility for the content, accuracy, privacy policies, or practices of these third-party sites.
When you access a third-party website or service through a link on our Site, you do so entirely at your own risk. SelfDecode is not liable for any loss or damage you may incur as a result of interacting with any third-party websites or services, including any purchases or transactions you make.
We encourage you to review the terms and conditions and privacy policies of any third-party websites or services you visit.
9. Acceptable Use Policy
a. Prohibited Activities:
You agree not to use the Services for any unlawful or unauthorized purpose. This includes, but is not limited to, the following:

Do not upload, post, or transmit any content that is:
Illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. 1
Discriminatory or hateful based on race, color, national origin, sex, sexual orientation, age, disability, religion, or any other protected characteristic.
Infringing upon the intellectual property rights of others.
c. Account and Security:
Do not impersonate any person or entity or misrepresent your affiliation with any person or entity.
Do not attempt to gain unauthorized access to any account or system.
Do not share your account credentials with others.
Do not violate any security measures implemented by SelfDecode.
d. Data and System Integrity:
Do not upload or transmit any viruses, malware, or other harmful code.
Do not scrape, crawl, or spider any part of the SelfDecode website or services.
Do not interfere with or disrupt the servers or networks connected to the Services.
Do not attempt to reverse engineer, decompile, or disassemble any part of the Services.
e. Other Prohibited Activities:
Do not stalk or harass other users.
Do not upload or transmit confidential or proprietary information that you are not authorized to disclose.
Do not engage in any activity that violates applicable laws or regulations, including data privacy laws such as the Genetic Information Privacy Act (GIPA) and the California Consumer Privacy Act (CCPA).
f. Enforcement:
You are solely responsible for any violation of this Acceptable Use Policy.
SelfDecode reserves the right to suspend or terminate your account and access to the Services if you violate this policy or if we have reasonable grounds to suspect a violation.
You agree to defend and indemnify SelfDecode against any liability, costs, or damages arising from your breach of this policy.
10. Content of SelfDecode Products
a. Product Descriptions:
SelfDecode provides detailed descriptions of each SelfDecode Product on the platform, including the science behind the product, its potential benefits and limitations, and the information it provides.
You are responsible for reviewing these descriptions and making informed decisions about which products to purchase based on your needs and understanding.
b. Product Content and Quality:
SelfDecode is responsible for the content and scientific accuracy of its products. We have a rigorous review process to ensure quality and adherence to our platform policies.
If you believe a SelfDecode Product does not meet our quality standards or violates our policies, please report it to Customer Support (support@selfdecode.com).
c. Communication with Customer Support:
When contacting Customer Support, please do not include any protected health information or sensitive personal information, as our communication channels may not be secure.
For inquiries about protected health information or privacy concerns, please contact our Privacy Team at privacy@selfdecode.com.
11. Electronic Communications
By using the Services, you consent to receive communications from SelfDecode electronically. These communications may include emails, text messages, in-app notifications, or messages on the SelfDecode website.
You agree that all electronic communications from SelfDecode satisfy any legal requirement that such communications be in writing.
While we primarily communicate electronically, you can also contact us by mail or phone if you prefer. Our contact information is available on the SelfDecode website.
12. Intellectual Property Rights
a. Ownership:
All content and materials on the SelfDecode platform, including but not limited to software, design, text, graphics, images, videos, databases, and user interfaces (collectively, “Content”), are owned or licensed by SelfDecode or its licensors.
b. Limited License:
SelfDecode grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services and Content for personal, non-commercial purposes, subject to these Terms of Service.
c. Restrictions:
You may not modify, reproduce, distribute, display, or create derivative works of any Content without SelfDecode’s prior written consent.
You may not use the Services or Content for any illegal or unauthorized purpose.
d. Feedback:
Any feedback, suggestions, or ideas you provide to SelfDecode (“Feedback”) are considered non-confidential and non-proprietary. SelfDecode may freely use and exploit Feedback without any obligation or compensation to you.
e. DMCA Notification:
If you believe any Content on the Site infringes your copyright, you may report it to SelfDecode in accordance with the Digital Millennium Copyright Act (DMCA) by providing the following information:
A description of the copyrighted work that you claim has been infringed.
A description of where the infringing material is located on the Site.
Your contact information (address, phone number, and email address).
A statement that you have a good-faith belief that the use is not authorized by the copyright owner.
A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Your electronic or physical signature.
13. Understanding the Limitations of Genetic Testing
SelfDecode provides genetic testing and interpretation services to help you learn more about your genetic makeup. However, it’s important to understand that genetic information has limitations and cannot provide a complete picture of your health or predict your future with certainty.
a. Not Medical Advice
SelfDecode’s services are for research, informational, and educational purposes only.
The information provided is not a substitute for professional medical advice, diagnosis, or treatment.
You should always consult with a qualified healthcare professional before making any health-related decisions or taking any action based on your genetic information.
b. Limitations of Genetic Interpretation

You agree to defend, indemnify, and hold harmless SelfDecode, its affiliates, licensors, and their respective officers, directors, employees, contractors, agents, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

17. General Practices Regarding Use and Storage
You acknowledge that, in accordance with the applicable laws and regulations, SelfDecode may establish general practices and limits concerning use of the Services, including without limitation the maximum number of days that Personal Information and Services content will be retained by the Service, the maximum disk space that will be allotted on SelfDecode’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Services in a given period of time. You acknowledge and agree that SelfDecode has no responsibility or liability for the deletion of or failure to store any messages, other communications, or other content maintained or transmitted by the Services; or for the loss of Genetic Information due to malfunction or destruction of data servers or other catastrophic events. You further acknowledge that SelfDecode reserves the right to change these general practices and limits in its sole discretion. Nothing in this section will be construed as to interpret any limitation on your rights to access, delete or request the correction of your information as per the terms of our Privacy Policy. 18. Account Closure
These Terms of Service remain in effect until terminated by you or SelfDecode.
You may terminate your agreement with SelfDecode at any time by closing your account. You can do this by contacting SelfDecode’s Customer Support or by sending a written notice to our designated address.
Upon account closure, your information will no longer be accessible through the Site or Services, except for the exercise of your rights under our Privacy Policy.
SelfDecode cannot restore access to closed accounts. If you wish to use the Services again, you will need to create a new account.
a. Future Changes and Data Access
SelfDecode may undergo changes in the future, such as mergers, acquisitions, or changes in ownership. In such events, SelfDecode reserves the right to transfer your data, including your Genetic Information and Personal Information, to the new operating entity or personnel. These Terms of Service will continue to apply to the use of your data. If you do not consent to the potential transfer of your data in such circumstances, you may close your account and request the deletion of your data as described in these Terms of Service and our Privacy Policy.
b. Export Restrictions
You may not download, export, or re-export any software, technology, or information from the SelfDecode platform to any person or entity on the U.S. Treasury Department’s list of Specially Designated Nationals, the U.S. Commerce Department’s Table of Denial Orders, or any other restricted party list.
By using the SelfDecode platform, you represent and warrant that you are not on any such list or located in, under the control of, or a national or resident of any restricted country.
19. Dispute Resolution
a. Agreement to Arbitrate
General Rule: Any dispute or claim arising out of or relating to these Terms of Service or your use of the Services, except for disputes relating to intellectual property infringement or misuse, will be resolved through binding arbitration rather than in court.
Exceptions:
EEA and UK Customers: For customers in the European Economic Area (EEA) and the United Kingdom, this arbitration agreement does not apply to disputes arising out of the application, interpretation, or enforcement of our Privacy Policy.
Intellectual Property Disputes: Either party may bring a lawsuit in court to enjoin infringement or other misuse of intellectual property rights.
b. Arbitration Procedures
Governing Rules: The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes.
Location: The arbitration hearing will be held in Orange County, California.
Language: The arbitration will be conducted in the English language.
Fees: The AAA’s rules will govern the payment of arbitration fees. The AAA Rules and fees are available online at www.adr.org or can be obtained by calling the AAA at 1-800-778-7879.
WAIVER OF CLASS ACTION
YOU AND SELFDECODE AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ANY CLAIMS OR DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY.
Severability
If any part of this Dispute Resolution section is found to be unenforceable, that part will be severed from the Terms of Service, and the remaining provisions will remain in full force and effect.

Assumption of Risk
By participating in the Holistic Lifestyle Coaching Program (“Program”), you acknowledge and accept the inherent risks associated with lifestyle changes and health coaching.
You take full responsibility for your well-being and all decisions made before, during, and after the Program.
Not Medical Advice
The information provided in the Program, including dietary and supplement recommendations, is not a substitute for professional medical advice.
SelfDecode is not a medical provider and does not diagnose, treat, or cure any medical condition.
Consult with a qualified healthcare professional for any health concerns or before making any decisions based on information provided in the Program.
Role of Health Coach
Your health coach is not a licensed medical practitioner and will not provide medical advice or treatment.
If you require medical services, your coach may recommend a licensed practitioner in your area.
Confidentiality
SelfDecode will treat your identifiable information, including medical history and coaching session content, as confidential.
Information may be disclosed to your healthcare providers or as required by law.
SelfDecode takes reasonable steps to protect the confidentiality of your information, but cannot guarantee the security of data transmitted over the internet.
Liability Waiver
You release SelfDecode from any liability for injuries or illnesses you may experience as a result of participating in the Program.
Dispute Resolution
Any disputes arising from the Program will be resolved through mediation or binding arbitration.
No Guarantees
SelfDecode makes no guarantees about the results you will achieve through the Program.
Your use of the coaching services is at your own risk.

21. Health Coaching Appointment Scheduling and Cancellation
Rescheduling and Cancellations
If you need to reschedule or cancel an appointment, please notify SelfDecode at least 24 hours in advance by emailing consults@selfdecode.com.
You may reschedule an appointment a maximum of two times. If you attempt to reschedule a third time, the appointment will be considered forfeited.
No-Shows
If you miss an appointment without providing at least 24 hours’ notice, you will be considered a “no-show.”
If you are more than 10 minutes late for an appointment, you may also be considered a “no-show.”
A rescheduling fee may apply if you reschedule an appointment after being marked as a “no-show.
22. Waiver and Severability
No waiver of these Terms of Service by SelfDecode shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure of SelfDecode to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms of Service will continue in full force and effect.
23. Entire Agreement
These Terms of Service, our Privacy Policy, and Platform Consent constitute the sole and entire agreement between you and SelfDecode with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Services.
24. Miscellaneous
These Terms of Service and any dispute or claim arising out of, or related to, them or the Site, their subject matter or their formation (in each case, including non-contractual disputes or claims) will be governed by and construed in accordance with California law, without regard to its conflicts of laws principles and excluding the applicability of United Nations Convention for the International Sale of Goods. To the extent that any lawsuit or court proceeding is permitted hereunder, you and SelfDecode agree to exclusively litigate such disputes in the state courts located in Orange County and the federal courts located in San Francisco County, California, and both parties consent to venue and personal jurisdiction in California. You may not assign any of your rights in these Terms of Service, and any such attempt is void. SelfDecode may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.
Any claim you might have against SelfDecode must be brought within two (2) years after the cause of action arises, or such claim or cause of action is barred. You also acknowledge and agree that any applicable state law implementation of the Uniform Computer Information Transactions Act (including any available remedies or laws) shall not apply to these Terms and is hereby disclaimed. A printed version of these Terms and of any related notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent as other documents and records originally generated and maintained in printed form. Please contact SelfDecode if you wish to receive a printed copy of these Terms.
SelfDecode and you are not legal partners or agents of one another. The relationship between you and SelfDecode is and shall be that of independent contractors and nothing in these Terms shall be construed or used to create or imply any relationship of partners, joint ventures, or employer and employee.
You may not assign or otherwise transfer these Terms or the license granted hereunder or delegate any of your duties specified herein, in whole or in part, without SelfDecode’s prior written consent. Any attempt of assignment, delegation, or transfer in violation of these Terms shall be void, of no effect, and a material breach of these Terms. Notwithstanding the foregoing, SelfDecode may assign these Terms in whole or in part. Moreover, SelfDecode may delegate its rights and responsibilities or use contractors or agents to fulfill its obligations under these Terms.
If any of these Terms are deemed inconsistent with applicable law, then such term(s) shall be interpreted in accordance with law, and no other terms will be modified. In the event any provision of these Terms is found by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, you agree that unless it materially affects the entire intent and purpose of these Terms, the invalidity, voidness, or unenforceability shall affect neither the validity of these Terms nor the remaining provisions herein, and the provision in question shall be deemed to be replaced with a valid and enforceable provision most closely reflecting the intent and purpose of the original provision. If we choose not to enforce any of these Terms, we are not waiving our rights.
If the performance of any part of these Terms by either party is prevented, hindered, delayed or otherwise made impracticable by reason of any flood, riot, fire, pandemic, public health crisis, judicial or governmental action, emergency, labor disputes, act of God or any other causes beyond the control of either party, that party shall be excused from such to the extent that it is prevented, hindered or delayed by such causes.
